Assault with Intent to Commit a Felony

Governed by Massachusetts General Laws Chapter 265 Section 29, the crime of Assault With Intent To Commit A Felony has a short definition, but a broad meaning. As far as definitions are concerned, in order for the prosecution to obtain a conviction of a defendant charged with this crime, the Commonwealth (the District Attorney) must prove beyond a reasonable doubt that:

  • The defendant assaulted the victim; and
  • That in so assaulting the victim the defendant had the intent to commit a felony

That is a pretty short, concise definition, but here is where it opens up wide: What is a “felony” offense? The list of what types of crimes can constitute felony offense is very broad and wide. The list can include everything from murder to rape to assault & battery with a dangerous weapon, but generally, a felony offense is a crime that is punishable by a state prison term of longer than 2 ½ years, up to life imprisonment. A conviction of Assault With Intent To Commit A Felony is punishable by incarceration of up to 10 years in state prison or by a maximum of 2 ½ years in a County Jail/House Of Correction, in addition to a maximum fine of $1,000.00.

This law for Assault With Intent To Commit A Felony was intended to cover all assaults where the defendant intended to commit a felony, but that is not specifically defined in another, separate statute. The Massachusetts Legislature has created separated, enumerated statutes for specific crimes that fall under the definition of Assault With Intent To Commit A Felony. Some examples of these crimes are found in M.G.L. Chapter 265 Section 18, which outlines the definitions and penalties for the crime of Assault With Intent To Rob or Murder, or Assault With Intent To Commit Rape, which is governed by M.G.L. Chapter 265 Section 24. The crime of assault with intent to commit a felony is intended to cover all assaults where the individual intended to commit a felony that is not specifically mentioned in another law. The legislature created this “umbrella” law to ensure that no offenses under this area of Massachusetts law were left uncovered.
